1 Introduction 

A - General
 
The Bridal Edition is retail provider of preloved bridal fashion where Customers can Purchase or Rent clothing and accessories. The Bridal Edition Limited is a private limited company registered in England and Wales under company number 16265046 and with a registered office at 2nd Floor, College House, 17 King Edwards Road, Ruislip, London, HA4 7AE, United Kingdom.
 
All Account Holders and Visitors are required to read, accept, and agree to comply with and be bound by these Terms & Conditions. If you do not wish to accept these Terms & Conditions, or any aspect of these Terms & Conditions, you should stop using the TBE Platform and the Services (both defined below) immediately.
 
We reserve the right to review and amend any of these Terms & Conditions from time to time with or without notice to you. The Bridal Edition strongly recommends that you revisit these Terms & Conditions each time you use the TBE Platform and the Services to familiarise yourself with any amendments.
 
B - Definitions

Terms with quotation marks shall have the meanings ascribed to them below or elsewhere in these Terms & Conditions.
 
“Account Holder”: an individual who has registered an account on the TBE Platform and has been accepted to use the Services.
 
“Renter”: an Account Holder who Rents Rental Items available through the TBE Platform.
 
“Buyer”: an Account Holder who Purchases Sales Items available through the TBE Platform.
 
“Customer(s)”: the collective term for Renter and Buyer.
 
“Seller”: any Account Holder who provides a Sale Item(s) for sale to The Bridal Edition for the Services on the TBE Platform.
 
“Lender”: any Account Holder who provides a Rental Item(s) for rent to The Bridal Edition for the Services on the TBE Platform.
 
“Rental Item(s)”: clothing and accessories made available for Rent on TBE Platform from time to time.
 
“Sale Item(s)”: clothing and accessories made available for Purchase on TBE Platform from time to time.
 
“Product Item(s)”: the collective term for Rental Item(s) and Sale Item(s)
 
“Potential Rental Item(s)”: a Rental Item that has not yet been accepted by The Bridal Edition for use of the Services.
 
“Potential Sale Item(s)”: a Sale Item that has not yet been accepted by The Bridal Edition for use of the Services.
 
“Potential Product Item(s)”: together a Potential Rental Item and/or a Potential Sale Item that has not yet been accepted by The Bridal Edition for use of the Services.
 
“Rental Fee”: the fee to Rent the Rental Item over the Rental Period.
 
“Rent/Rental/Renting”: to rent a Rental Item via the TBE Platform for which a Renter pays a Rental Fee and is subject to these Terms & Conditions.
 
“Purchase/Buy/Buying”: to purchase a Sale Item via the TBE Platform for which a Buyer pays a Sale Price and is subject to these Terms & Conditions.
 
“Sell/Selling”: to sell a Sale Item via the TBE Platform for which a Buyer pays a Sale Fee and is subject to these Terms & Conditions.
 
“Sale Price”:  the fee to Purchase a Sale Item.
 
“Delivery Fee”: the cost for each Rental Item to be delivered and returned as part of the Services or the cost for each Sale Item to be delivered as part of the Services.
 
“Cleaning Fee”: the cost for each Rental Item to be cleaned in between Rentals as part of the Services.
 
“Total Sale Price”: together the Sale Price and the Delivery Fee when you place your purchase order for a Sale Item.
 
“Total Rental Fee”: together the Rental Fee, the Delivery Fee and the Cleaning Fee (if applicable) when you place your rental order for a Rental Item.
 
“The Fees”: the collective term for the Rental Fee, Sale Price, Delivery Fee and Cleaning Fee where appropriate in these Terms & Conditions.
 
“Security Deposit”: a refundable security deposit may be required for high-value items of up to 10% of the item’s value.
 
“Rental Period”: the length of time the Rental Item is Rented by Renter. Currently listed Rental Periods are 4, 8 and 15 days. The Rental Period is measured from the date the Rental is due to start (and includes Bank Holidays, weekends and other holidays) being the Rental Start Date, to the day the final day of the Rental Period, being the Rental End Date.
 
“Rental Start Date”: the date on which the Rental of a Rental Item begins. This is deemed to be the start of the Rental Period.
 
“Rental End Date”: the date on which the Rental of a Rental Item ends. This is deemed to be the final day of the Rental Period.
 
“Replacement Value”: a reasonable estimate of the current market value of a Rental Item by The Bridal Edition. The Bridal Edition’s determination is final and binding on the Lender and Renter. The estimate may change from time to time.
 
“TBE Platform”: The Bridal Edition website found at www.thebridaledition.co.uk and/or any other medium including, made available by The Bridal Edition.
 
“Normal Wear & Tear”: micropulls, small loose threads, unobvious stains or marking, minor rips, missing beads, or other minor damage.
 
“The Bridal Edition”: The Bridal Edition Limited, we, us, our.
 
“Services”: the TBE Platform and services and Content provided via the TBE including facilitating the Renting and Selling of Product Items for Customers.
 
“Visitor(s)”: people who are accessing and making use of the TBE Platform and are not yet registered as Account Holders.
 
“Product Item Descriptions”: the product details about a Rental Item or a Sale Item including, but not limited to, product specifications, size, colour, style, shape for the use of the Services.
 
“Product Item Photos”: photographs, illustrations, videos or images of a Rental Item or a Sale Item for the use of the Services.
 
“Delivery Address”: a safe and secure location where a Customer can physically receive the Product Item.
 
“Promotions”: Promotion activities including, but not limited to, contests, giveaways, raffles, prizes, surveys.
 
“Content”: includes Product Item Descriptions, Product Item Photos, other text, graphics, images & videos (including any other images/photographs/videos that we take of Product Items), sound recordings, audio-visual works, and other similar materials provided by or on behalf of The Bridal Edition for the purposes of the Services by The Bridal Edition.
 
“Intellectual Property Rights”: refers to legal rights that protect creative work and brand identity. These include (but aren’t limited to) patents, copyrights, trademarks, trade dress, design rights, domain names, business names, database rights, and rights over confidential information (like know-how and trade secrets). This applies whether or not the rights are registered, and includes the ability to apply for, extend, renew, or enforce those rights now or in the future, anywhere in the world.
 

2 Terms & Conditions for all Customers

A -  Registration & Account Holder Terms

In order to access and make use of the full range of Services, you will be required to set up an account and register to become an Account Holder by completing a generated registration form.
 
You will need to supply certain personal information to complete the registration form successfully. After you have successfully completed the registration form, you will be provided with an account and login information to enable you to access the Services.
 
Account Holders agree and understand that we may collect, use, store and process your personal information in accordance with our Privacy Policy. We treat your personal data with the utmost care and comply with UK GDPR regulations. To find out more about when and why we collect your personal information, how we use it and how we keep it secure, please refer to our Privacy Policy. For information about how we use cookies on the TBE Platform, please refer to our Cookie Policy.
 
To keep your account secure, you are the only person who should use and access it. The Bridal Edition may accept or decline any account registration at our discretion, and we also reserve the right to deactivate accounts at any time, for example, if we believe someone has breached these Terms & Conditions.
 
You are responsible for keeping your account safe. If someone else uses your account without permission, and that causes any loss or damage, you will be held responsible. In that situation, you also agree to cover any losses or claims made against The Bridal Edition as a result.
 
When you register, you agree that all information you provide is accurate and complete. If anything changes, please update your details as soon as possible. Please note, providing incorrect or incomplete information could cause delays or additional fees when using our Services which we will not be responsible for.
 
You will have the option to sign up for our emails to hear about the latest styles, launches and updates (and you can unsubscribe at any time).
 
To create an account with us, you must be over 18 and legally able to enter into a binding contract in the UK.
 
B - Renting and Buying
 
When you Rent a Rental Item or Purchase a Sale Item, you're entering into a binding agreement with The Bridal Edition. By doing so, you confirm that you've read, understood, and agreed to these Terms & Conditions and that you are fully responsible for following them.
 
Please note, we currently only offer sales and rentals within the United Kingdom.
 
All of our Product Items are pre-owned and may show signs of Normal Wear & Tear. That’s part of what makes them unique! We do our best to describe and photograph each item as accurately as possible for listings on the TBE Platform. However, small variations may occur, and we cannot accept responsibility for any minor differences or resulting issues.
 
If you’d prefer to try something on before ordering, we welcome you to book an appointment at our London store. Please note, that appointment booking fees are non-refundable.
 
We love capturing the magic of our in-store appointments, try-ons, and events and we may use this content (photos, videos, sound recordings, etc.) to promote The Bridal Edition across our website, social media, and marketing materials. By agreeing to these Terms & Conditions, you’re giving us permission to do so. If you’d rather not appear in any content, just let us know by emailing support@thebridaledition.co.uk with your name, and the date and time of your appointment.
Please make sure all the information you provide is correct. Inaccurate details could lead to delays or additional fees (for example, for delivery), which we unfortunately cannot be responsible for.
 
C - Content
 
All the content you see on our Services including Product Item Descriptions, photos, stylist advice, and more - is provided “as is” and is meant to be used for general information only. While we always strive to keep everything accurate and helpful, we cannot guarantee that all content will be wholly accurate or up to date at all times.
 
We may update or edit any part of the Content, including Product Item Descriptions, whenever we feel it is needed and we may do so without notifying you in advance.
 
D - Delivery
 
All deliveries are handled by our shipping partners, who we may change from time to time. When you place an order, we’ll provide estimated delivery and arrival information via the TBE Platform, or directly through our shipping partners.
 
Delivery and Collection
We will dispatch Product Items to your Delivery Address. Delivery options are shown on the TBE Platform at checkout. We currently offer:
  • Next day delivery, if an order is placed by 12pm, Monday to Friday.
    • Orders placed on Saturdays by 12pm, will arrive on Monday.
    • Orders placed on Sundays by 12pm will arrive on Tuesday.
  • Standard delivery within 2-5 business days.
If you're Renting, the Rental Start Date is the date we aim to deliver your Rental Item. If we deliver the Rental Item before the Rental Start Date, your original booking will not be impacted, i.e. you will not be charged further Rental fees, and the Rental End Date of your Rental Period will remain per your current order.
 
Please note, The Bridal Edition is not responsible for items left unattended or collected by someone other than you. It’s important that the Delivery Address you provide is accurate and complete, any errors can lead to delays or extra charges, which you will be responsible for.
 
Store collection – Product Items that have been rented or purchased can be collected from our boutique. If you are Renting, your Rental Item must be collected on the Rental Start Date. We will provide you with a specific date and time for collection for each Product Item in advance.
 
E- Fees & Payments
 
Fees
All Fees must be paid in Pounds Sterling (£). We may update or change our Fees from time to time via the Services, with or without notice. If you’ve already placed an order, the Fees at the time of your booking will still apply.
 
We may also offer promotional pricing from time to time, or introduce new Services with different Fees, these will be clearly stated when you book or buy.
 
Making Payments via Stripe
We use Stripe, a secure third-party platform, to process all payments.
By using our Services, you confirm that the payment details you provide are accurate and not fraudulent, and you authorise us to share necessary information with Stripe for processing your transaction. Stripe may sometimes require you to complete additional identity checks before you can use our Services.
 
Making Payments via Klarna
Customers also have the option to select Klarna as a payment method for Product Items.
By using our Services, you confirm that the payment details you provide are accurate and not fraudulent, and you authorise us to share necessary information with Klarna for processing your transaction. Klarna may sometimes require you to complete additional identity checks before you can use our Services.
 
Non-Payment
If payment isn’t made on time, we may need to take steps to recover the amount owed. You’ll be responsible for any reasonable costs of collection, including legal or recovery fees.
 
Promotional Activities
From time to time, we might run Promotions. If you take part, please read the rules of that specific Promotion they may differ slightly from these Terms & Conditions. If there’s a conflict, the Promotion rules will take priority.
 
F - Refund Policy
 
We will offer a refund if:
  • A Rental Item arrives damaged beyond wearability. Please email us at support@thebridaledition.co.uk by 8pm on the Rental Start Date, including clear photo evidence of the damage. The item must remain unworn and be returned via our normal return process. If you choose to wear the item, we will assume you have accepted it, and a refund won’t be issued and you may also be subject to additional fees under these Terms & Conditions.
  • We cancel your order within 48 hours of the Rental Start Date or the estimated delivery date for a Sale Item. This may happen if:
    • If a Product Item is no longer available after you’ve placed an order.
    • If there is a delay with sending out the Rental Item because of a previous rental delay or damage
  • If you receive the wrong Product Item.
  • If there is delay in delivery or non-delivery by our delivery partners.
We are unable to offer a refund if:
  • You decide not to wear your Rental Item, even if it arrives on time.
  • The item arrives later than expected because the order was placed too close to your event date.
Processing your refund
If your refund request is approved, we’ll process it within ten (10) days. Refunds will be issued to the original payment card or to any other card listed in your account with us.
 
G- Cancellation Policy
 
For rentals
If you wish to cancel more than seven (7) days of the Rental Start Date, you will receive a full refund of the Total Rental Fee associated with the cancelled order, minus a cancellation charge being £10 to cover administrative costs.
 
Requests to cancel your rental order can be made by visiting the My Rentals section of your account or by emailing support@thebridaledition.co.uk.
 
Any cancellation made within seven (7) days of the Rental Start Date will not be reimbursed and you will be charged the full amount of the Total Rental Fee and any other additional fees payable under these Terms & Conditions.
 
Any Security Deposit being held shall be returned to you within ten (10) days of cancellation.
 
For buyers
Unfortunately, all wedding gown dress sales are final.

3 Rental Terms
A - General
 
These following conditions apply to Renters using our Services to rent a Rental Item.
 
Please note that only items marked as available for rent on the TBE Platform can be rented, some Product Items are available for purchase only.
 
We always recommend trying on Rental Items in our store before placing your order to ensure the best fit and look. If you choose not to try on before renting, The Bridal Edition cannot be held responsible if the item doesn't fit or isn't worn.
 
B - Rental Fee
 
When you place your order to rent a Rental Item, you will be charged the Total Rental Fee shown at the time of booking on the TBE Platform. We also charge a Security Deposit and/or a Cleaning Fee on some Rental Items; these will be shown on the TBE Platform at checkout.
 
We may change prices, apply discounts, or update the availability of Rental Items from time to time at our discretion, but changes will not affect orders already placed.
 
By placing an order, you authorise us (or our payment partner) to charge your payment card for the Total Rental Fee immediately.
 
Please make sure your payment method has sufficient funds to cover both the Total Rental Fee and, if necessary, the Replacement Value and/or Security Deposit. If any charges become payable under these Terms, you authorise us to charge your card accordingly.
 
C - Use of the Rental Items
 
Rental Items are professionally cleaned and ready to wear before they are sent out, using our trusted cleaning partners.
 
While we check every item thoroughly, use of Rental Items is at your own risk. The Bridal Edition is not responsible for any health-related issues that may arise.
 
You are fully responsible for the care of the Rental Item during the Rental Period and must not allow anyone else to wear or use it.
 
Please handle your Rental Item with care and return it in the same condition it arrived. If the item is lost, stolen, damaged beyond Normal Wear & Tear, or altered in any way, you may be charged additional fees.
 
Please do not clean, iron, or attempt to alter the Rental Item in any way, we will take care of all that for you.
 
D - Lost, Stolen or Damaged Fees
 
If a Rental Item is returned needing repairs beyond Normal Wear & Tear, deep cleaning beyond our normal cleaning procedures, or cannot be rented again due to damage, we’ll charge you accordingly, up to the Replacement Value of the item, in addition to your Total Rental Fee.
 
If your Rental Item is lost or stolen while in your possession, we’ll charge the full Replacement Value in addition to your Total Rental Fee.
 
(together the “Lost, Stolen or Damaged Fee”).

E - Return of Rental Items
 
You are responsible for making sure the Rental Item is returned on the final day of the Rental Period, i.e. the Rental End Date.
 
We include a prepaid return label and full return instructions in your booking confirmation email. Items must be dropped off for return delivery by 12pm on the Rental End Date. If your return date falls on a Sunday or Bank Holiday, please drop off the item by 12pm the next day.
 
If you collected your Rental Item in store, you must also return it in person. We will provide you with a specific date and time for store drop offs in advance.
If any protective packaging, such as sunglass cases or garment bags, is not returned, you will be charged a £10 replacement fee.
 
If you received any complimentary items with your rental and do not return them, you will be charged the full replacement value of each item.
 
Once we have confirmed the Rental Item has been returned in acceptable condition, at our discretion, we will refund your Security Deposit within ten (10) days. If the item is damaged, charges may be applied up to the Replacement Value.
 
F - Lost Return Packaging
 
If you lose the Return Packaging, you will be responsible for returning the Rental Item at your own expense by the Rental End Date and provide The Bridal Edition with a tracking number.
 
G - Extensions
 
You may request an extension to your current Rental Period by emailing support@thebridaledition.co.uk. Extensions are only possible if the Rental Item is available (i.e. there are no conflicting orders) and the additional Rental Fee is prepaid. Extension requests must be made before your Rental Start Date.
 
H - Late Fees
 
If you return a Rental Item late, we will charge a late fee, calculated as a daily pro-rata amount based on your Rental Fee (the “Late Fee”).
 
Late Fees apply each day the item is overdue, up to a maximum charge of 100% of the Replacement Value (plus any applicable Total Rental Fees).
 
If a Rental Item is more than 14 days late, we’ll consider it lost and we will charge you:
  • the Replacement Value of the Rental Item, less any Late Fees that you have already paid (but in addition to any Total Rental Fees) and plus
  • The Total Rental Fees incurred by The Bridal Edition in not being able to fulfil other rentals for the Rental Item (“Unfulfilled Total Rental Fees”).
 I - Maximum Charges
 
The Bridal Edition will not charge you for more than an amount equal to:
  • 100% of the Replacement Value, plus
  •  the Total Rental Fee, plus
  •  and Unfulfilled Total Rental Fees.
If you pay The Bridal Edition an amount equal to 100% of the Replacement Value, plus any applicable Total Rental Fees, and Unfulfilled Total Rental Fees and you still possess the Rental Item, the Rental Item is yours to keep, though on an “as is” basis without any guarantees or warranty.
 
J - Charge of Lost, Stolen or Damaged Fees and Late Fees
 
If your Rental Item is lost, stolen, returned damaged, or returned late, we will automatically charge the relevant amount to your payment card including Late Fees and Lost, Stolen or Damaged Fees without requesting further permission.
 
If any amounts are outstanding and unpaid, we may instruct a collections agency or pursue a legal claim. In that case, their fees may also be added to your total balance.
 

4 Sale Terms

The following conditions apply to Buyers using our Services to buy a Sale Item.
 
Please note that only items marked as available for purchase on the TBE Platform can be bought, some Product Items are available for rental only.
 
All purchase orders are final. We always recommend trying on Sale Items in our store before placing your order to ensure the best fit and look.
 

A - Sale Price 

When you place your order to buy a Sale Item, you will be charged the Total Sale Price shown at the time of booking on the TBE Platform.
 
We may change prices, apply discounts, or update the availability of Sales Items from time to time at our discretion, but changes won’t affect orders already placed.
 
By placing an order, you authorise us (or our payment partner) to charge your payment card for the Total Sale Price immediately.
 

5 Lender & Seller Terms

 

 A - Before Collection, Delivery or Drop off of Potential Product Items
 
If you would like to sell or lend with us, a full description of any Potential Product Item must be shared with The Bridal Edition via our online form before collection, post or drop off.
 
B - Collection, Delivery or Drop off of Potential Product Items
 
For Potential Sale Items we may offer collection if you are based nearby to our London store. Collections may be arranged via our shipping partners. Collection is only offered for Potential Sale Items.
 
Sellers also have the option to arrange for the delivery of their Potential Sale Item to The Bridal Edition at their own expense; any risk of loss in transit will be borne by the Seller.
 
For Potential Rental Items: Lenders must arrange delivery of their Potential Rental Item to The Bridal Edition at their own expense; any risk of loss in transit will be borne by the Lender.
 
Lenders and/or Sellers also have the option to drop off their Potential Product Items at The Bridal Edition.
 
Once you hand over a Potential Product Item (whether in person or by post), you're confirming that you agree to these Terms & Conditions.
 
C - Our Evaluation and Acceptance Process
 
When we receive a Potential Product Item, we acknowledge that all Potential Product Item Items are pre-owned (second-hand) and we will carefully inspect it to assess its authenticity, quality, and how suitable it is for sale or rental.
 
Within ten (10) business days, we will email you confirming if their Potential Product Item has been accepted. If your item is accepted, it becomes a Product Item and will be listed on the TBE Platform for the use of the Services.
 
If your Potential Product Item is not accepted, it is your responsibility to collect it or arrange return shipping. If you don’t retrieve your Potential Product Item within 30 days, ownership of the item will transfer to The Bridal Edition.
 
D - Fake, Counterfeit and Stolen Potential Product Items
 
If we believe a Potential Product Item is fake, counterfeit, or stolen, we may be required by law to destroy the item or report it to the authorities.
 
By submitting an item, you confirm you have no reason to believe it is fake, counterfeit, or stolen.
 
E - Before Listing on the TBE Platform
 
You hereby grant us the right to retain Product Items in our possession and acknowledge that Product Items will be stored in a secure location with sufficient insurance cover (up to the Replacement Value).
 
Before listing the Product Item, The Bridal Edition will photograph the Product Item to document its condition.
 
You also grant us the right to make minor amendments and repairs to any Product Items, for example the replacement of buttons and minor stitching repairs.
 
We cannot guarantee the preservation of the Product Items in their original condition and cannot be held liable for any depreciation in value due to the nature of preloved items.
 
The Bridal Edition will make suggestions for the Rental Fee or the Sale Price. However, the final decision for setting these will be at your discretion.
 
You grant us the right to take or make Product Item Photos for the use of the Services and any other such purposes as we see fit.
 
F - Listing on the TBE Platform
 
For each Product Item, the Product Items Descriptions and the Product Item Photos will be displayed on TBE Platform for use of the Services in a manner that we see fit (“Listing”). You also acknowledge that the Product Items Descriptions and Product Item Photos are drafted and created at our discretion.
 
We will use all reasonable efforts to ensure that Product Item Descriptions and Product Item Photos accurately match the corresponding Rental Item or Sale Item to the best of our ability but cannot be liable for any inaccuracies or any losses or damages resulting from it. We may amend a Listing to include additional details without requiring prior approval.
 
The Rental Fee and Sale Price listed may from time to time include promotions and/or other discounts applied by us to facilitate the rent of a Rental Item and sale of the Sale Item which you agree we can apply without requiring prior approval.
 
We cannot guarantee a Product Item will rent or sell. We also reserve the right to cancel any rental or sale Listings of Product Items for any reason.

G - Managing the Product Item
 
You grant us the right to fully manage Product Items while in our possession including but not limited to delivery, cleaning in between rentals (for Rental Items), return (for Rental Items), payment collection from Customers and marketing.
 
You agree that we shall have the right to make use of all Product Items (including images) for the purposes of, including but not limited to, communications, marketing, such as social media posts, press releases, media events and publications and photo shoots. All intellectual property borne from such activities resides with us solely.
 
We guarantee that each Product Item shall have visibility through the TBE Platform and on our social media channels using the Product Item Photos or other Content created. Visibility for how and when The Product Item is showcased on our social media channels is at our discretion.
 
H - Withdrawal or Cancellation of a Listing by The Bridal Edition
 
If we determine that a Product Item is unlikely to generate sufficient further interest for rental or sale or decide to withdraw the relevant Product Item listing, we will notify you. You will then have the option to:
  • Have your item returned at your expense; or
  • Grant ownership of the Product Item to us.
If we do not hear from you within 30 days of the notification, ownership of the item will automatically transfer to us.
 
I - Withdrawal / Cancellation of a Listing by the Lender and/or Seller
 
You may withdraw/cancel your Listing and have your Product Item returned at any time (outside of any active rentals) by emailing support@thebridaledition.co.uk. Return shipping fees are at your expense. Collection of a Product Item from us is also possible.
 
Termination fees for Withdrawing a Listing
For a Rental Listing, during the first 180 days from the date a Rental Item is listed by The Bridal Edition any such request will incur the following early termination fee:
  • the Total Rental Fees for each accepted rental order by us at the time of the request that we will no longer be able to fulfil.
For a Sale Listing, any such request will incur the following termination fee:
  • 10% of the Sale Price per each Sale Item.
Once we have returned your item, we’ll remove it from the TBE platform promptly.
 
J - Commissions and Payment
 
Sales
For each successful sale of any Sale Item, we take a 30% commission of the Sale Price and you, as the Seller, will receive 70%. For the avoidance of doubt, the Sale Price used to calculate commission excludes any other applicable fees (the “Sales Commission”).
 
The Sales Commission shall reflect all applicable promotions and/or other discounts applied directly to or associated with a sold Sale Item. 
 
Sales Commission payments will be made on the 15th of every month for items sold in the previous calendar month.
 
Rentals
For each successful rental of any Rental Item, we take a 20% commission of the Rental Fee and you as the Lender will receive 80%. For the avoidance of doubt, the Rental Fee used to calculate commission excludes any other applicable fees (the “Rental Commission”).
 
The Rental Commission shall reflect all applicable promotions and/or other discounts applied directly to or associated with the rental of a Rental Item. 
 
Rental Commission payments will be made on the 15th of every month for items sold in the previous calendar month.
 
K - Lender and/or Seller’s Representations, Warranties and Indemnification
 
When you list an item with us, you represent and warrant that:
  • You legally own it and have the right to sell or lend it.
  • It’s authentic and was obtained lawfully.
  • The description you provide is accurate and complete.
  • It doesn’t infringe on any third-party rights (e.g. trademarks).
 
You agree to indemnify The Bridal Edition against any claims or legal costs arising from your item being misrepresented or infringing on someone else’s rights.
 
L - Use of the TBE Platform & Services
 
You agree not to use our platform to:
  • Complete any sales or rentals offline that were initiated through The Bridal Edition.
  • Promote your own commercial activities unrelated to listing, renting or selling your Product Items.
You also agree to indemnify us against any claims, costs, or liabilities arising from misuse of our platform or breaches of these Terms & Conditions.

6 Lender Rental Terms

A - The Bridal Edition’s Use of the Rental Item

Before a Rental Item can be accepted for use of the Services, we will make a reasonable estimate of the Replacement Value which must be accepted by you. The estimate may change from time to time.
 
The Bridal Edition agrees to treat the Rental Item with great care and to return it to you as close to the original condition when we received it. However, you acknowledge that further wear & tear will arise each time the Rental Item is rented.
 
The Bridal Edition accepts it will be charged additional fees if the Rental Item is lost, stolen or damaged beyond Normal Wear & Tear.
 
We will not materially modify the Rental Item; however, you grant us the right to attempt repairs on it to return it back to its original condition in a manner we see fit and at our discretion.  
If we return a Rental Item that is damaged or stained beyond Normal Wear & Tear, then we agree that we shall be liable for the cost of repairing, additional cleaning or replacing the Rental Item, which will be determined at our discretion but only up to the Replacement Value.
 
If a Rental Item is lost or stolen during the time the Rental Item is in our possession or during a rental, then we agree to pay the Replacement Value.
 
The Bridal Edition will not be charged for more than an amount equal to 100% of the Replacement Value.

B - Rentals on Other Rental Platforms
 
The Bridal Edition will not restrict the Lender from listing their Rental Item with other rental platforms (“Other Rental Platforms”).
 
You must give notice to us by emailing support@thebridaledition.co.uk at least three (3) business days if you have accepted a rental order for your Rental Item on Other Rental Platforms and the rental dates. If this rental order clashes with a Rental Period for an existing rental order made with The Bridal Edition, our rental orders will take priority.
 
You acknowledge that The Bridal Edition does not need to give you notice when your Rental Item is being rented out to a Renter by us. However, this information can be requested by emailing support@thebridaledition.co.uk.
 
Delivery and Return  
As the Rental Item will be in our possession, we must hold the right to fulfil the delivery and return; the cost of which will be borne by you and these delivery costs must be paid to us before the Rental Item is sent out for delivery.
 
You acknowledge that providing anything other than accurate personal information to fulfil a rental order delivery for a rental on Other Rental Platforms will result in delays and additional delivery fees for which we will not be liable.
 
It is the Lender’s responsibility to ensure renters on Other Rental Platforms have been informed that personal information (such as their name and delivery address) will be shared with The Bridal Edition to fulfil delivery and return.
 
Deliveries and returns will follow the clauses in Section 2D – Delivery and Section 3E - Return of Rental Item.
 
If the Rental Item is not returned by the final day of the rental period of a rental order on Other Rental Platforms, the you agree to pay The Total Rental Fees incurred by The Bridal Edition in not being able to fulfil other rentals for the Rental Item (the “Lender Late Fee”).
 
The relevant funds for the Lender Late Fee will be charged to the payment card included in your account information that you have provided to The Bridal Edition without your permission.
 
Service Fee
The Bridal Edition will fulfil and manage the delivery and return of three (3) rentals made on Other Rental Platforms, free of charge (less the delivery and return fees) within a six (6) month period.
 
Further requests to fulfil and manage the delivery and return will result in a 15% service fee of the rental fee of the order on Other Rental Platforms (the “Service Fee”) in addition to delivery and return fees. The Service Fee will be payable at the same time as the delivery and return fees.
 

7 The TBE Platform, Services and Content

A - Changes to the TBE Platform and the Services

We may occasionally update or make changes to parts of the Services to improve user experience, including certain features or functions. These changes might be made without prior notice, and we cannot be liable for any impact they may have.
 
In some cases, these updates may affect previously available features or any information you have previously provided. By continuing to use the Services after changes are made, you agree to those updates.
 
The Services are offered on an “as is” basis, and while we aim to keep everything running smoothly 24/7, access may occasionally be interrupted due to maintenance, upgrades, or reasons beyond our control. We will endeavour to provide updates about scheduled downtime in advance, however we are not required to do so.
 
It’s your responsibility to ensure you (and anyone else using your internet connection) understand these Terms & Conditions and comply with them.
 
While we aim for uninterrupted access, technical glitches or maintenance needs may occasionally cause temporary downtime. We appreciate your understanding and patience. However, we also cannot be liable for any losses caused by data transfer issues over the internet or other communication networks.

B - Use of the TBE Platform
 
By accessing and using the TBE Platform, we grant you a limited, non-transferable licence to use it for your personal, non-commercial use in accordance with these Terms & Conditions.
 
In doing so, you will not:
  • Republish, copy or distribute our Content without permission.
  • Attempt to access the source code or introduce any harmful code or software.
  • Use the TBE Platform for unlawful purposes or to gather data for a competing business.
  • Upload anything that infringes on the rights of others or is offensive or inappropriate.
  • Misrepresent yourself or interfere with the site’s functionality in any way.
If you violate this Section, we may suspend or restrict your access to the TBE Platform. We also reserve the right to edit or remove anything from your account that does not align with these terms.
 
The TBE Platform is based in the UK. If you are accessing the TBE Platform accessing from outside the UK, you do so at your own discretion and are responsible for complying with local laws.

C - External Sites
 
The TBE Platform may contain links to third-party websites (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites.
 
The content of such External Sites is developed and provided by others. We are not responsible for the content of any linked External Sites.
 
D - Intellectual Property & Content
 
All Intellectual Property Rights related to the TBE Platform, the TBE Platform content (such as design and code), our Content and related services belong to The Bridal Edition or our licensors.
 
You are welcome to view, print or download content for personal use, but you must not republish, reproduce, sell, or share it without our written consent.
 
The Bridal Edition name and logos are our trademarks. You may not use them, or any third-party trademarks shown on our platform without our written consent. Any goodwill from the use of our trademarks belongs to us.
 
Violating these terms means your right to use the TBE Platform ends immediately, and you must delete any downloaded content.
 

8 Miscellaneous

A - No Warranties/Limitation of Liability

 While we carefully curate every item and partnership, The Bridal Edition does not make any guarantees or endorsements regarding Product Items, vendors, or customers. Use of the Services and any rented or purchased items is at your own risk.
 
We cannot be responsible or liable for:
  • Loss or injury caused using any Product Items.
  • Incidental or consequential damages, including data or income loss.
  • Events beyond our control (e.g., natural disasters, pandemics, shipping disruptions).
B - Termination of an Account
 
You can request to deactivate your account at any time (outside of any active rentals) by emailing us at support@thebridaledition.co.uk. You understand that your personal information may continue to exist and be used on or through the Services even after such deactivation for regulatory and compliance purposes.
 
We reserve the right to restrict or terminate your account, including cancelling orders or Listings if necessary, for reasons including, but not limited to, item availability, identity verification, breach of terms, or for legal or regulatory compliance. We may do this without prior notice or liability.
 
C -Deletion of an Account
 
To request the deletion of your account, email us at support@thebridaledition.co.uk. As soon as your request to delete your account has been confirmed as actioned by The Bridal Edition, you will not be able to receive any additional Product Items through our Services.
 
You may continue to keep Rental Items you have already received, but you must return all such Rental Items to The Bridal Edition on or before the final day of the Rental Period during which you requested The Bridal Edition to delete your account.
 
If we do not receive your items within ten (10) business days the Rental End Date, you will be charged up to the Replacement Value of the Rental Item.
 
Account deletion will be actioned upon the return of all Rental Items.
 
You will not be entitled to any refund on any Rental Fees you have paid.
 
D - Disputes
 
In the event that you have a dispute with us, please email us at support@thebridaledition.co.uk so that a resolution can be found.
 
Informal Dispute Resolution
Both you and us will agree that in the event of any dispute between us, we will first contact the other party and make a good faith sustained effort to resolve the dispute before resorting to more formal means of resolution.
 
Formal Dispute Resolution
 In the unlikely event that we have not been able to resolve a dispute informally, you and us each retain the right to seek relief in the small claims court.
 
Any claim, dispute or matter arising under or in connection with these Terms & Conditions shall be governed and construed in all respects by the laws of England and Wales.
 
E - Third-Party Rights
 
This agreement is between you and The Bridal Edition only. No other person has any right to enforce any of these terms under the Contracts (Rights of Third Parties) Act 1999, or otherwise.

This does not affect any other rights or remedies that are stated elsewhere in this agreement or available under general law.

 F - Terms & Conditions Jurisdiction and Enforcement
 
We reserve the right to take action against you for breach of these Terms & Conditions, even if action is taken at a later date.
 
These Terms & Conditions are governed by the laws of England and Wales.
 
Our failure to act on or enforce any provision of these Terms & Conditions shall not be construed as a waiver of that provision or any other provision in these Terms & Conditions. No waiver shall be effective against us unless made in writing.
 
Except as expressly agreed by us and you in writing, these Terms & Conditions constitute the entire agreement between you and us with respect to the subject matter, and supersedes all previous or contemporaneous agreements, whether written or oral, between the parties with respect to the subject matter.
 
In the event that any part of these Terms & Conditions are found by a court to be unreasonable, unenforceable or void, that part shall be severed, and the remainder of the clauses shall be enforceable with such deletion or modification as may be necessary to make it effective and for such period as is found to be reasonable and valid.
